Fairplay Commitment
1. DEFINITIONS
1.1 In these conditions:
‘Condition’ means the standard terms and conditions of sale set out below, including any special terms and conditions agreed in writing by us;
‘Contract’ means any contract for Goods made between you and the Company;
‘Goods’ means the packaged products or services which we shall supply in accordance with these Conditions;
‘We’ means Bathstore which is the trading name of Bathstore.com Limited. trading as Bathstore | Registered in England & Wales Company Number: 2240475 | Registered Office: 2nd Floor, Meridien House, 69-71 Clarendon Road, Watford, WD17 1DS. Vat no. 125517037. Bathstore operate franchised stores and in these cases ‘we’ means the company as indicated on the face of the Contract. Some terms may vary in franchise stores;
‘You’ means the customer seeking to purchase the Goods from us and ‘Your’ shall be construed accordingly;
2. PRICE
The price of the Goods shall be the price given on the date you place your order and will be confirmed on your invoice. The price of the Goods will include VAT at the prevailing rate. Delivery charges may be applicable to your order. Ask in store for details. Prices correct at time of print. Errors and omissions excepted.
3. DEPOSIT ORDERS
We guarantee to hold the price of the goods as appears on you invoice for 90 days from the date of your order, if the order has not been paid in full by this time Bathstore reserves the right to update your order with any price changes that have come Into effect since the order was placed. This may result in the cost of your order increasing.
4. DATE FOR PAYMENT
You shall pay for the Goods at your local Bathstore in full either at the time you place the order or, if a deposit has been paid, at least 7 days prior to delivery being made, with cleared funds, otherwise the delivery date may be cancelled and re-scheduled.
5. ORDER CHANGES
Should you wish to change the order, delivery date or delivery address, you should contact your local Bathstore no later than 7 days prior to your original agreed delivery date to enable us to perform the Contract.
6. COLLECTION AND DELIVERY
6.1 Our home delivery service options and pricing will be explained at the point of order.
6.2 Home deliveries are generally made between 7.30am and 8pm. A convenient delivery date will be agreed with you at the point of placing your order. Some franchised stores have separate delivery services which may operate outside these times. You will be informed of this at the point of purchase.
6.3 You shall be responsible for making all necessary arrangements to take collection of the Goods.
6.4 Any specific, or exceptional, delivery requirements should be agreed with your local Bathstore at the point of purchase.
6.5 Delivery charges for orders outside mainland Britain or in the Highlands of Scotland may vary.
6.6 If you fail to take delivery of the Goods or fail to give us adequate delivery instructions on the date agreed for delivery, then we reserve the right to charge you the subsequent delivery charges.
6.7 We recommend that you do not confirm the start date with your installer until you have received and checked your delivery. If you do not check your delivery is correct before Installation starts Bathstore will not accept liability for any additional costs that you incur while any product Issues are resolved.
6.8 You agree to accept delivery within 30 days of the date you make payment in full for your order unless otherwise agreed. We reserve the right to charge storage charges at the rate of 2% of the total order per month if orders are delivered outside 30 days.
6.9 Risk of damage to, or loss of the Goods shall pass to you at the time we deliver to your agreed delivery address.
Delivery Options
We have developed 4 great delivery service options to give you the maximum convenience and fastest possible delivery of your dream bathroom.
Express:
Designed to get small items to you as quickly as possible, the next day in most cases, if you order before 2pm (deliveries will be made between 7.30am and 8.00pm).
Express Plus:
We’ve added a GUARANTEED before noon service for added speed and convenience, if you order before 2pm (deliveries will be made between 7.30am and 12 noon).
Premium Home Delivery:
As the specialists, we know that some of our bathroom products require special handling. Our Premium Home Delivery service includes added features such as timed delivery windows and room of choice delivery.
Store Collect:
We know everyone is busy and for complete convenience, selected small items can be delivered to store FREE OF CHARGE for collection (in-store offer only).
Express
If your item is suitable for carrier delivery we’ll usually get it to you the next working day (excluding Bank Holidays), or any future working day of your choice, if you order in-store or over the phone before 2pm (deliveries will be made between 7.30am and 8.00pm)*. We’ve designed this service to cover over half of our products so you can now receive your dream bathroom even quicker. Ask in-store for details.
If you order on a Friday, Saturday or Sunday before 2pm, we will deliver to you during Monday. Remember, you can also specify a different delivery address if you order in-store and have your order delivered to your workplace, a friend’s place, etc. for your added convenience.
Express Plus
This service has the same features as our Express service, but as we understand you are busy, we aim to deliver before 12 noon the next working day (excluding Bank Holidays), or on any future working day morning of your choice, if you order before 2pm (deliveries will be made between 7.30am and 12 noon)*.
On the day before your delivery you will receive an email confirming that your delivery has been shipped, and on the day of delivery you will be sent an email and text advising you of your one hour delivery timeslot. If the delivery date is not suitable you can use the links on the emails, or by reply to the text, to change the date that your order will be delivered. The emails will also provide you with links to track your orders progress through its delivery cycle.
* Please check your Express delivery times with your local store if you live in one of the following postcode areas: AB, DD9 and DD10, FK20, HS, IM, IV, KA27 and 28, KW, PA, PH, PO, PO30, TR, ZE.
Premium Home Delivery
Many of our products, including baths and shower enclosures, require special handling due to their size and weight. To give a great customer experience, we’ve developed our Premium Home Delivery service which includes the following features:
• 2 people on the van
We will take extra care of your bathroom delivery.
• Choice of delivery dates
If all of your goods are in stock at our warehouse, you will be given a choice of delivery dates at the point of order.
• Reservation of stock
We will reserve your stock at the point of full order payment for complete peace of mind.
• 3-5 day lead time
Premium Home Deliveries are usually made within 3-5 working days.
• 4 hour time slot
We will call you the day before to confirm a 4 hour delivery window (You will receive an email and/or text, the evening before the delivery day, confirming the 4 hour delivery time window) so you don’t waste any unnecessary time waiting in (please note that the delivery may arrive slightly early).
• Call ahead
We will call you on the day of delivery when we are within 30 minutes of making your delivery.
• Room of choice
Our drivers will carry your order to the room of your choice where possible so no shifting of heavy boxes!
Delivery times are usually Monday to Friday (excluding Bank Holidays) 7.30am-8.00 pm. We will confirm your 4 hour delivery time window the day before your delivery is made (If for any reason you do not receive this information please call Panther Customer Services on 01788 823656, option 2). If you have ordered any items requiring special handling, we will automatically arrange for your whole order to be delivered on our Premium Home Delivery service for complete peace of mind.
At the time of order you can also specify a Premium Home Delivery, rather than an Express delivery, for your small items if you wish to benefit from the unique features of this service. Delivery availability and charges for orders outside mainland Britain or in the Highlands of Scotland may vary.
Store Collect
For your added convenience, we can deliver selected small items direct to your local store for collection at the store manager’s discretion. As we deliver to our stores anyway, we are able to offer this service FREE OF CHARGE. Ask for details of your local store’s delivery dates.
Check your delivery
At the point of delivery please check that the number of items delivered matches the number advised on the delivery note, so that the note can be amended prior to the delivery team’s departure. We then recommend that you complete a full check of your items as soon as possible after delivery. Please open each box and check that everything is as ordered and appears in good condition. Bathstore offers a no quibble replacement policy for items incorrectly supplied or damaged in transit during our delivery. Please notify your local store within 7 days and we will arrange to put things right as fast as we can.

Your delivery charge will be calculated by the total amount within your basket. Express delivery restrictions do apply to the following postcodes. Outside mainland Britain: prices available upon request.
7. LOSS OR DAMAGE TO GOODS ON DELIVERY
7.1 We recommend that you examine the Goods to check that they are as ordered and undamaged as soon as possible after delivery. Please open each box and check that everything is as ordered and appears in good condition. Bathstore will replace Goods free of charge that have been incorrectly supplied or damaged in transit during our delivery. Please notify your local store within 7 days from the day after the day on which the Goods were received and we will arrange for a replacement item to be delivered and the damaged item to be collected.
7.2 All damaged Goods, wherever possible, should be returned in their original packaging.
8. CANCELLATION RIGHTS – GOODS ORDERED Instore, VIA THE INTERNET OR TELEPHONE
8.1 You will be entitled to cancel the Contract with us in the following circumstances:
8.1.1 Where goods have not been installed and you are unhappy with the Goods, for whatever reason, and notify us before the expiry of 7 days from the day after the day on which the Goods were received; or
8.1.2 Where Goods supplied are faulty or not in accordance with the specifications of your order.
8.2 A refund will be reimbursed to you within 28 days from the day after the day on which the cancellation was made. This is subject to us being given reasonable opportunity to collect, inspect and confirm the goods are in acceptable condition for return.
8.3 This right of cancellation does not apply to special orders of products not featured in the Bathstore Catalogue or where goods are specifically made to your specification or personalised at your request.
8.4 Except when goods are faulty, all Goods must be returned unused and in their original packaging.
8.5 We cannot refund Goods that have been damaged while in your possession.
9. WARRANTY AND LIABILITY
9.1 Proof of purchase is required before any warranty claim can be assessed.
9.2 We shall make good by reimbursement of the whole or part of the price or, at our option, by repair or by replacement any defect developing under normal domestic use of the Goods within the stated guarantee period for the product effected, see below for full details of our product guarantees.

9.4 Save as provided elsewhere, our liability for death or personal injury caused by our negligence shall be unlimited and for all other loss or damage which you may suffer or incur in connection with the supply of Goods, our liability shall be limited to that caused by a natural and reasonably foreseeable consequence for which we are at fault or negligent.
10. GENERAL
10.1 We shall have no liability whatsoever for any failure to perform, or for a delay in the performance of any of our obligations under the Contract arising wholly or in part by reason for any factor beyond our direct control.
10.2 In placing an order with us, you warrant that you are a resident of the United Kingdom and that you have the necessary permission and authority to enter into this Contract.
10.3 Where any competent authority deems any Condition to be invalid or unenforceable in whole or in part, then the offending part shall be removed and the validity of the remainder of the Condition shall not be affected.
10.4 These Conditions do not purport to confer a benefit on any third party by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.
10.5 The Contract and these Conditions shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts.
10.6 Any notice required or permitted to be given by either party to the other under these Conditions shall be in writing addressed to the other party and delivered to the address provided at the time the order is confirmed or any subsequent or alternative address which one party may notify to the other from time to time.
10.7 The terms and conditions do not affect your statutory rights.
PRICE GUARANTEE
At Bathstore we are confident that our prices will be the lowest. If you find any equivalent product cheaper at another store, we will match the price and beat it.
- We will match the third party price quote and also deduct a percentage of the difference (the amount of deduction is at our discretion).
- All we ask is that you apply before your purchase or within 14 days of purchase from us. Where applicable a Bathstore proof of purchase (receipt) is required.
- Your claim must be supported by a written quotation for the relevant product from the competing retailer.
- Bathstore will only beat quotes from competing high street retailers. All quotes from online retailers are excluded.
- Price quotes will only be beaten for each eligible item purchased from us.
- The product(s) must be equivalent in all material aspects including style, quality, materials and structure. We reserve the right to refuse to beat the price of items not deemed to be equivalent at our sole discretion.
- The comparison will be made against the actual Bathstore store price including any discounts or offers applicable at the time the application is made.
- The price guarantee excludes installation and delivery charges.
- Bathstore reserve the right to withdraw or amend the Bathstore price guarantee at any time without notice.

PRODUCT GUARANTEES
All Bathstore products are engineered & manufactured to exacting standards and carry our additional guarantee over your statutory rights covering all manufacturing faults.
Product Range:
Lifetime guarantee – All our ceramic Basins, Bidets and Toilets are guaranteed for 20 years, which is a reasonable life expectancy for a modern bathroom. Our guarantee covers all ceramic parts and excludes any non ceramic component parts such as cabinets, seats, cistern fittings, non ceramic wastes and our Express sanitaryware range of basins and toilets. This guarantee is effective on all qualifying purchases from 25.02.13.
10 Year Guarantee - All our baths, shower enclosures, shower heads, brassware, radiators & shower trays.
5 Year Guarantee – Furniture including resin basins, natural stone work tops and washbowls, cabinets & whirlpool baths.
2 Year Guarantee - Toilet seats, Basics products, Home accessories, summer heating kits, shower pumps, wastes, cistern fittings, lighting products & illuminated mirrors.
Statutory rights - consumables, such as light bulbs, shower hoses, tap and shower cartridges.
How to Claim:
In the unlikely event that you encounter a problem with a Bathstore product, you should return it to the Bathstore that supplied you. In the case of e-commerce sales, you should contact the help desk as indicated on the Bathstore e-commerce website. They will be able to advise whether it is due to faulty product or faulty installation. If the problem is due to a manufacturing fault, they will arrange the supply of a replacement product.
Our Guarantee:
We will replace at our discretion, in part or whole, a product which is defective in operation, materials or workmanship. If the exact model is no longer available, we will endeavour to provide the nearest equivalent from our then current range. To be covered by the guarantee, all products should be installed in accordance with the instructions provided and be for domestic use only. Products must be purchased and installed in the UK and Ireland only. This product guarantee applies to the original purchaser or end user and the original installation address only, is non-transferable and takes effect from the date of purchase. The guarantee does not cover damage during fitting, accidental or malicious damage, improper use or negligence, discolouration due to prolonged exposure to sunlight or UV light, general wear and tear ( for example light bulbs, hinges, cartridges & shower hoses are items that do need to be replaced periodically ), damage due to poor installation or servicing or consequential loss. Shower hoses, tap and shower cartridges & furniture hinges are guaranteed for one year. Care should be taken in hard water areas to ensure that cartridges are regularly cleaned. We require original proof of purchase to be provided for us to be able to consider any claim, so please keep your invoice and/or receipt.
Bathstore reserve the right to alter the details of, or wholly withdraw elements of these guarantees entirely at their discretion. Existing commitments will be honoured up to the date the change is made and in accordance with the terms of this document.
Our Guarantee is in addition to your statutory rights, and does not affect your statutory rights.
Ex-Display Products:
Products sold as ex display have been installed in our stores and may well have scuffs and cosmetic damage consistent with normal use and where ever possible we have tried to show affected areas prior to sale.
Ex-display products are sold without Bathstore's extended guarantees. This does not affect customer's statutory rights.
